Hologic has decided to discontinue the manufacturing, sales and marketing of its Adiana system. The decision was based primarily on the economics, after determining the product was not financially viable and would not become so in the foreseeable future. As part of this decision, Hologic has resolved ongoing litigation with Conceptus concerning patent infringement claims. In conjunction with this settlement, the parties have agreed that in exchange for Conceptus agreeing to forgo the $18.8m jury award, Hologic would agree to a permanent injunction against the manufacture, sale and distribution of the Adiana permanent birth control device.
Today's announcement has no impact on the safety and efficacy of Adiana. This decision was not mandated by any regulatory body or authority. Patients who have had Adiana have no reason to be concerned. We stand behind Adiana as a safe, effective alternative for women and will continue to passionately pursue our ongoing commitment to providing improved health for women everywhere.
